Twenty-two years ago, in the immediate aftermath of the horrendous 9/11 attacks, the US Congress passed the Public Law 107-40 under an Emergency Measures provision. This law unapologetically “authorized the use of United States Armed Forces against those responsible for the recent attacks launched against the United States.” A necessary step, it seemed, to protect the nation from further harm.
Fast forward to the present day, a worried citizen would wonder why this law, born from a state of emergency and extraordinary circumstances, still stands firm. This concern was shared by Senator Rand Paul, who recently proposed an amendment to drop the Emergency Measures provision.
However, his initiative was overwhelmingly voted down by 86 out of 100 Senators.
Why does this law, born out of crisis, continue to exist in a world far removed from the immediate threat of post-9/11?
